Basics of law.

Teaching Methodologies

The following teaching methodologies are used in this curricular unit: interpretation and analysis of the legal provisions and exposure of contents by the teacher and its discussion with the students; resolution of practical real case studies and court decisions by the students.

Learning Results

It is intended that the student is able to:

a) interpret and apply the legal regime of the individual employment contract;

b) distinguishing an employment contract from a service provision contract;

c) celebrate employment contracts in their different modalities;

d) identify rights and duties of workers and employers;

e) apply in specific cases the legal solutions regarding the execution of the employment contract (namely with regard to anual leave and absences, remuneration, organization of working time, exercise of disciplinary power, etc.);

e) differentiate the various forms of the extinction of the employment contract.

 

Program

1. Characterization and historical evolution of labour law.

2. Sources and application of labour law.

3. The legal regimen foreseen for labour contract: legal notion; modalities; general provisions on subjects; perfection and invalidity of labour contract; rights, duties and guarantees of the parties; rendering of work.

4. Breach of contract;

5. Termination of labour contract;

6. Collective labour law;

7. Liability for crimes and other administrative sanctions in labour law.
