Basics of Administrative Law.

Teaching Methodologies

The syllabus will be treated using two complementary methodologies: interpretation and analysis of legal provisions and exposition of the contents by the teacher and their discussion with the students; resolution of practical cases and jurisprudential decisions by students.

Learning Results

At the end of the course unit the student should be able to:

a) Distinguish territorial planning programs and urban plans;

b) Identify the function and scope of action of the various types of territorial management instruments in force and the essential stages of their elaboration process.

c) Know the main rules for land occupation, use and transformation that characterize Urban Planning Law in Portugal.

d) Recognize norms of urban plans aiming at their own execution.

e) Know and identify the special administrative procedures aimed at controlling the legality of urban planning operations.

f) Identify and distinguish the general principles of environmental law;

g) Know the administrative activity in environmental matters and the submission of activities potentially harmful to the environment to prior control, namely through environmental impact assessment procedures, environmental licensing or industrial licensing.

 

Program

1. Concepts and objects of land management law, urban planning law and environmental law.

2. The territorial management system.

3. The legal framework for territorial management instruments: classification, content, functions and procedure for preparing or revising territorial development instruments and territorial planning instruments in particular.

4. Public participation of individuals in urban planning activities.

5. Instruments for implementing urban plans.

6. Protection of the environment through law.

7. Environmental law principles.

8. Civil liability for environmental damage.

9. Sanctions law: administrative offenses and environmental crimes.

10. Administrative environmental law: prior control procedures.
