Deontology and Solicitorship History

Base Knowledge

The course unit presupposes basic knowledge of the courses Introduction to Law, Constitutional Law and Administrative Law.

Teaching Methodologies

The teaching method is theoretical and practical, essentially appealing to the critical participation of students in the discussion of practical situations, similar to those they will encounter in forensic life.

Learning Results

The learning objectives are aligned with the teaching method adopted, as they aim to:

01. A historical understanding of the OSAE (Social Security Agency) with a view to internalizing a deep sense of belonging and its role in Portuguese society.

02. An understanding of the main functions of Solicitors and Enforcement Agents as assistants in the proper administration of justice, in the forensic world and in Portuguese courts.

03. An understanding of the range of ethical and deontological duties placed on their shoulders, in the context of a profession with limited access and regulated practice.

04. An identification of the method of practice and dissemination of their image and professional information.

05. The importance of professional secrecy as a generator of trust, honorability, good name, and reputation for the profession.
06. The limits and sanctions for deviations from the values of the profession, especially civil, disciplinary, and criminal protection.

1. A Brief History of the Ethics and Professional Conduct of Solicitors and Enforcement Agents

2. From the Chamber of Solicitors to the current OSAE: organizational structure and competencies

3. Disabilities, incompatibilities, and impediments.

3. (Provisional) Registration.

4. Professional Societies: incompatibilities, impediments, and lack of suitability.

5. Proper Acts of Solicitors.

7. The ethical duties of Solicitors, Enforcement Agents, and Professional Societies.

8. Disciplinary, civil, and criminal liability.

9. Attire, image, information, and advertising of OSAE Members.
