Teaching Methodologies

The following teaching methodologies are used in this curricular unit: interpretation and analysis of the legal provisions and presentation of the content by the teacher, followed by discussion with students; analysis and resolution of practical case studies and court decisions by the students. 

Learning Results

Objectives:

  1. To understand the impact of digital technologies and the Internet of Things on individuals and consumers, especially on the right to privacy and on the right to informational self-determination;
  2. To acquire and to apply the rules laid down in the General Data Protection Regulation (GDPR);
  3. To understand the current importance of e-commerce and to know the principles and rules governing e-commerce activity and the specificities of online contracting;
  4. To acquire and to apply the principles and rules protecting online business, including the protection derived from intellectual property law and regulations (e.g. copyright, patents, utility models, topographies of semiconductor products and domain name rules).

Learning outcomes:

  1. Students should be able to critically understand the legal implications arising from technological developments associated with the Internet of Things, with particular emphasis on the protection of individuals’ fundamental rights, especially regarding privacy and informational self-determination;
  2. They are expected to master the regulatory framework of the General Data Protection Regulation (GDPR) and apply it appropriately to real-world contexts;
  3. Furthermore, students should recognise the growing importance of electronic commerce and be able to identify the legal principles and rules governing electronic contracting, taking into account its specific features;
  4. Finally, they should become familiar with and be able to apply the legal instruments that regulate personal and corporate identity in the digital environment, with particular attention to intellectual property rights, including copyright, patents, utility models, semiconductor topographies and domain names.

Legal issues related to the Internet of Things (IoT):

  1. The clash between IoT and personality rights and consumers’ right to privacy;
  2. Analysis of the General Data Protection Regulation (GDPR);
  3. Online contracts;
  4. Intellectual property rights: rights, limits and enforcement.

Grading Methods

The curricular unit adopts, as its ordinary and structuring model, a continuous assessment regime, designed to measure, on a progressive and cumulative basis, the acquisition of knowledge, critical-argumentative maturity, and the ability to apply legally grounded reasoning to complex and emerging problems within the field of Internet of Things (IoT) Law. Assessment comprises written components, individual research work, and performance in a teaching-and-learning context. 

Assessment Methods

A) Continuous Assessment

1. Two written tests (50% of the final grade)

Weighting: 

  • 1st test: 25%
  • 2nd test: 25%

2. Individual research assignment (30% of the final grade)

Weighting:

  • Research project topic (proposal): 5%
  • Written paper: 10%
  • Oral presentation and defence: 15%

Notes: 

(a) The research project topic (proposal) and the written paper are subject to mandatory submission. Failure to submit either the proposal or the written paper entails the award of 0 (zero) marks (0-20 scale) in the corresponding component.

(b) Failure to comply with the submission deadline for the research project topic (proposal) and/or for the written paper entails the award of 0 (zero) marks (0-20 scale) in the corresponding component, irrespective of subsequent submission. 

(c) The oral presentation and defence shall only take place if the student obtains a minimum mark of 9.50/20 in the written paper (0-20 scale). 

(d) A student who fails to achieve the minimum mark referred to in the preceding paragraph shall not be admitted to the oral presentation and defence and shall be awarded 0 (zero) marks for that component. 

3. Completion of activities and oral participation (20% of the final grade)

Weighting:

  • Activities (in-class and online): 15%
  • Oral participation: 5%, assessed through classroom interventions during the resolution and discussion of the completed activities. 

Attendance (mandatory requirement)

  1. Attendance constitutes a mandatory requirement for enrolment and participation, given the cumulative, problem-oriented and dialogical nature of the curricular unit, as well as the central role of in-class and online activities in the assessment of competencies. 
  2. Students may not exceed 5 (five) unexcused absences throughout the semester. 
  3. The justification of absences is governed by the applicable academic regulations, and students must comply with the relevant deadlines, formal requirements, and evidentiary means. 
  4. Failure to comply with the attendance requirement precludes approval in the curricular unit, without prejudice to the final assessment regime provided below. 

B) Final Assessment (Examination)

A student who does not obtain approval under the continuous assessment regime may sit the final assessment, in accordance with the applicable regulations. The final grade shall be determined as follows:

1. Written examination (70% of the final grade)

2. Individual research assignment (30% of the final grade)
